Terms and Conditions

The following terms and conditions (“Terms”) govern the Expedia TAAP - 'Start Booking Now' campaign.

Dates/Eligibility:

The Expedia TAAP “Start Booking now” campaign (“Promotion”) begins at 12:01 AM PT on August 1, 2020 and ends at 11:59 PM PT on December 31, 2020 (“Promotion Period”). The Promotion is open to any travel agent in the United States who (i) is a member in good standing of any one of the following agency networks – Archer Travel Group, Cruises and Tours, Cruise Planners (“Agency Networks”) – as confirmed by the relevant Agency Network, (ii) has registered for the Expedia’s Travel Agent Affiliate Program (“Expedia TAAP”) with a valid Expedia US PoS TAAP tracking code during the Promotion Period, (iii) has done their first ever booking on TAAP during the Promotion Period, and (iv) is at least eighteen (18) years old (each an “Eligible Participant”). Employees of Expedia, Inc., as well as the immediate family (spouse, partner, parents, legal guardian, siblings, and children) and household members of those employees are not eligible to enter the Promotion.

Agreement to Terms and Conditions:

By entering the Promotion, you indicate your full and unconditional agreement to (a) these Terms and (b) Sponsor’s (as defined below) decisions as to the eligibility or disqualification of Eligible Participants and Eligible Bookings (as defined below) and as to compliance by any person with these Terms, which are final and binding. Winning a Prize (as defined below) is contingent upon fulfilling all requirements set forth herein.

How to participate:

Eligible Participants will receive an email with a link to the Promotion page where they must enter their details and accept these Terms in order to participate.

Eligible Bookings:

To enter, an Eligible Participant must make a booking for a customer for (i) a standalone hotel, and/or (ii) package which includes a hotel booking through Expedia TAAP during the Promotion Period (each an “Eligible Booking”). If the customer completes the stay during the Promotion Period, the Eligible Participant will receive one (1) entry into the drawing associated with the month in which the Eligible Booking was completed.

An Eligible Participant may only receive one (1) entry during the Promotion Period.

Prizes:

Fifteen (15) winners will each receive a Visa Gift card worth $100 USD (collectively, the “Prize(s)”). The total value of the Prizes is $1,500 USD.

Selection of Winners:

On or about September 1, 2020, October 1, 2020, November 1, 2020, December 1, 2020, and January 1, 2021, one (1) winner will be selected per Agency Network in a random drawing of all Eligible Bookings that were completed in the previous month. Three (3) winners will be selected each month, assuming that at least one (1) Eligible Booking was completed per Agency Network. Cancelled itineraries will not count as Eligible Entries. The odds of winning depend on the number of Eligible Entries received for each drawing. Winners will be notified by e-mail and may be required to sign and return an Affidavit of Eligibility/Release of Liability and Publicity Form within ten (10) days of the date notice is sent to claim his/her Prize. Noncompliance will result in disqualification and selection of alternate winners. All drawings for this Promotion will be conducted by Sponsor’s Agent (as defined below), whose decision is final in all matters relating to the Promotion. If potential winners do not respond, Sponsor is unable to contact a potential winner, or a potential winner is not in compliance with these Terms, the Prize will be forfeited, and at Sponsor’s discretion, an alternate entrant may be notified.

Conditions:

In the event that the operation, security, or administration of the Promotion is impaired in any way, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Terms; or (b) award the Prizes at random from among the Eligible Entries received up to the time of impairment. Sponsor reserves the right in its sole discretion to disqualify any individual who tampers with the operation of the Promotion, violates these Terms, or acts in an unsportsmanlike or disruptive manner. Sponsor reserves the right to seek damages from any person who seeks to undermine the legitimate operation of the Promotion. Failure by Sponsor to enforce any term of these Terms shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to the owner of an entry, the authorized account holder of that code used to enter will be deemed to be the entrant. The Promotion is subject to federal, state and local laws and regulations and is void where prohibited.

Release and Limitations of Liability:

By participating in this Promotion, the winner grants the Sponsors permission to use their name and likeness for advertising and future promotional purposes without additional compensations (except where prohibited). Winners are liable for any tax liability accruing as a result of this Promotion. No transfer, assignment or substitution of a Prize is permitted by any winner. Entrants agree to be bound by these Terms. By participating in this Promotion, entrants agree to release and hold harmless Expedia, its officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in this Promotion, or receipt or use of any Prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Promotion or the processing of entries; or (f) injury or damage to persons or property. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, incidental, consequential, direct, or indirect damages. By entering this Promotion, you acknowledge that you have read and understood and agree to be bound by these Terms.

Disputes:

You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Washington. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington.

For a listing of the names of the Prize winners, send an email to support@expedia-agents.com. Winners’ names will be sent when the Promotion Period has concluded and the Prizes have been awarded. Requests for winners’ names must be received by email.
