Terms and Conditions

The following terms and conditions (“Terms”) govern the Expedia “All Inclusive Your Way” campaign that you are entering into in your capacity as TAAP Member (as defined in the Expedia Travel Agency Affiliate Agreement (“TAAP Agreement”) between you and Sponsor).

1. Dates/Eligibility: The Expedia TAAP “All Inclusive Your Way” campaign (“Promotion”) begins at 12:01 AM PT, Oct 1, 2022 and ends at 11:59 PM PT, November 30, 2022, (“Promotion Period”). Promotion is open to any TAAP Member in Canada (excluding Quebec) who (i) has registered for Expedia’s Travel Agent Affiliate Program (“TAAP”) with a valid Expedia Canada PoS TAAP tracking code; and (ii) is at least 18 years old (each, an “Eligible Participant”).
   
   Employees of Sponsor as well as the immediate family (spouse, partner, parents, legal guardian, siblings, and children) and household members of those employees are not eligible to enter the Promotion.
   
   
2. Agreement to Terms and Conditions: By entering the Promotion, you indicate your full and unconditional agreement to (a) these Terms and (b) Sponsors’ decisions as to the eligibility or disqualification of Eligible Participants and Eligible Bookings and as to compliance by any person with these Terms, which are final and binding. Winning a Prize or Prizes is contingent upon fulfilling all requirements set forth herein.
   
   
3. How to Enter:
   
   Expedia Canada TAAP Members: Eligible Participant opts into the Promotion by making a standalone or Package Rate (as defined in the TAAP Agreement) all-inclusive hotel booking on Expedia TAAP Canada.
   
   
4. Eligible Bookings
   
   An Eligible Participant who makes a standalone or Package Rate (as defined in the TAAP Agreement) all-inclusive hotel booking on Expedia TAAP Canada between Oct 1, 2022 and November 30, 2022 and check-out occurred between Oct 1 2022 and April 30, 2023 (“Eligible Booking”) is eligible to receive an entry into the Prize Draw (“Eligible Entry”).
   
   Each Eligible Booking made will constitute one (1) Eligible Entry into the Prize Draw. 
   
   
5. Prizes: One (1) CAD $2000 gift card of your choice from select retailers, one (1) CAD $1000 gift card of your choice from select retailers and three (3) CAD $500 gift cards of your choice from select retailers (each a “Prize,” collectively, “Prizes”) will be awarded to randomly selected Eligible Participants from Eligible Entries received at the end of the Promotion Period. The approximate retail value (“ARV”) of the Prizes is CAD $4500.
   
   Use of gift card is subject to terms and conditions applicable to the gift card as stipulated by Sponsor and/or gift card provider. Sponsor reserves the right to determine the gift card provider and the type of gift card to be awarded. No gift cards will be redeemed for cash. Sponsor reserves the right to substitute the Prize with another prize of equal or greater value, if the Prize is not available for any reason, as determined by Sponsor in its sole discretion. Sponsor will not be liable for any Prizes which are lost, delayed, or damaged for reasons beyond its control. The commercialization of the gift cards is prohibited by these Terms.
   
   
6. Selection of Winner: The winner/s will be selected on or about December 15, 2022 from among all Eligible Entries received during the Promotion Period by Sponsor or its agent, Discover the World, 7020 E Acoma Dr. Scottsdale, Arizona 85254 (“Agent”). Cancelled itineraries will not count as Eligible Entries for the Prize. Odds of winning depend on the number of Eligible Entries received. Winners will be notified by e-mail and required to sign and return an Affidavit of Eligibility/Release of Liability and Publicity Form within ten (10) days of the date notice or attempted notice is sent to claim his/her prize. Noncompliance will result in disqualification and selection of alternate winners. All prizes and drawing for this Promotion will be conducted by Agent, whose decision is final in all matters relating to the Promotion. If potential winners do not respond, Sponsor is unable to contact a potential winner, or a potential winner is not in compliance with these Terms, prizes will be forfeited, and at Sponsor’s discretion, an alternate winner may be notified.
   
   
7. Conditions: In the event that the operation, security, or administration of the Promotion is impaired in any way, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Terms; or (b) award the prizes at random from among the eligible entries received up to the time of impairment. Sponsor reserves the right in its sole discretion to disqualify any individual who tampers with the operation of the Promotion, violates these Terms, or acts in an unsportsmanlike or disruptive manner. Sponsor reserves the right to seek damages from any person who seeks to undermine the legitimate operation of the Promotion. Failure by Sponsor to enforce any term of these Terms shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to the owner of an entry, the authorized account holder of that code used to enter will be deemed to be the entrant. The Promotion is subject to federal, state and local laws and regulations and is void where prohibited.
   
   
8. Release and Limitations of Liability: By participating in this Promotion, the winner grants the Sponsors permission to use their name and likeness for advertising and future promotional purposes without additional compensation (except where prohibited). Winners are liable for any tax liability accruing as a result of this Promotion. No transfer, assignment or substitution of a prize is permitted by any winner. By participating in this Promotion, you agree to release and hold harmless Sponsor, its officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in this Promotion, or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Promotion or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Promotion or acceptance, receipt use or misuse of any prize. You further agree that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney's fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, incidental, consequential, direct, or indirect damages. By entering this Promotion, you acknowledge that you have read and understood and agree to be bound by these Terms.
   
   
9. Disputes: You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded (include non-contractual disputes or claims) shall be resolved exclusively by the courts of State of Washington. The Sponsor(s) and you each waive, to the fullest extent permitted by law, trial by jury of all claims arising out of or relating to these Terms. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, your rights and obligations, or the rights and obligations of the Sponsor(s) in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of State of Washington, without regard to any conflict of laws, rules or principles that may require the application of any other law.
